The offshore pathway suits two very different situations. You may be in Australia while your partner is overseas waiting to join you. Or you may both be living abroad, with the Australian in the relationship sponsoring a move home together. Both are common and both work.
What matters for the sponsor is their status, not their postcode. An Australian citizen, permanent resident or eligible New Zealand citizen can sponsor from anywhere. Where each of you needs to be at lodgement and at decision depends on your circumstances and on the rules as they currently stand, which is one of the first things we check for you.
Once the 309 is granted your partner can live, work and study in Australia. The permanent subclass 100 is generally assessed around two years after the original lodgement date, with earlier eligibility in some circumstances.
Book a time using the form below. We will send a short questionnaire so we understand your situation before we speak, then talk it through by video conference or phone call. Time zones are not a problem and your partner is welcome to join. You will leave knowing which pathway fits, what evidence to start gathering, and what it costs. Our recommendations follow in writing.
Each member of our team is carefully chosen and are able to walk you through your application, stress free.

After 10 years I finally have permanent residency thanks to freedom migration. My case was tricky and they were very clear with deadlines and helped me through every step. Also accepted split payment, which made it possible for me to have their help with my visa. I wouldn't be in Australia without their assistance. Would highly recommend.Posted on Google![]()

Thanks Julie and her team so much! My partner and I has thr 820 visa granted ~18 month. Our application was rushed and somewhat difficult as we weren’t together very long when we decided to applied the partner visa. Julie has helped to analyse our situation and came up with a great suggestion and we followed through, which has led us to a granted visa so we are super grateful for that!Verified by TrustindexTrustindex verified badge is the Universal Symbol of Trust. Here are some questions we’re often asked about our services. If yours isn’t covered, feel free to get in contact with us!
They are two stages of the same application, lodged together. The subclass 309 is the provisional visa that lets your partner come to Australia and live, work and study here. The subclass 100 is the permanent stage, generally assessed around two years after the original lodgement date. Some applicants are eligible for the simultaneous grant of the 309 and the 100 together, this is also known as a double grant.
Yes. This is one of the most common situations we see. If one of you is an Australian citizen, permanent resident or eligible New Zealand citizen, you can sponsor your partner from wherever you are currently living. Plenty of couples lodge from London, Dubai, Singapore or anywhere else and plan the move to Australia together.
Your plans for returning are part of the conversation, so come prepared to talk about timing.
Where each of you needs to be at lodgement and at decision depends on your circumstances, and the requirements have changed in recent years. Rather than rely on something you read on a forum, tell us your situation and any travel you have planned and we will confirm the current position for your application.
The one thing worth knowing early is that travel plans can affect timing, so mention them before you book flights.
Often yes, on a visitor visa, but it is not automatic. Holding a pending partner application can affect how a visitor visa is assessed, and some visitor visas carry conditions that create problems later. Talk to us before booking anything.
It depends on where your partner currently is, what visa options they have, and how long you are prepared to be apart. This is one of the main things we work through in a consultation, because choosing wrong can cost you precious time.
No. Married couples and de facto partners both apply for the same subclasses. De facto applicants usually need to show at least twelve months of a genuine de facto relationship before lodging. If you are engaged rather than married or de facto, the Prospective Marriage visa (subclass 300) may be the better fit, and we can talk you through it.
If you’re confused about your visa application or don’t quite know where to start, this consultation is for you.
Our consultation is a one-hour session during which we’ll discuss your relationship, highlight any red flags, and give you a clear strategy for what to do next.
Our consultations are designed to educate and empower you, to make you confident about choosing the right Partner Visa pathway for your relationship.
Our initial process looks like this:
1. Make your booking by filling out the form above
2. Receive and complete a short questionnaire
3. Have your 1 hour consultation by video conference or phone call. Here, we’ll go over your love story and then delve into the legalities involved in applying for your visa. Answering any questions you may have as we go along.
4. After your session we’ll send through a written summary of our chat and our recommendations on your next steps.
We guarantee to provide honest, candid advice about your application.
We also promise not to bamboozle you with legal jargon, make false promises or force you into a corner with aggressive sales tactics.
Instead, we’ll give it to you straight. Honest, fluff-free advice so you don’t waste your time and hard-earned cash.
At Freedom Migration we pride ourselves on transparency and honesty and our reputation says the same. As such, we like to set your expectations of the consultation by outlining what’s not included in an initial Partner Visa consult.
1. A full visa application review – our initial consultation is usually a 1 hour session in which we help uncover any mitigating factors and provide you with a clear strategy towards the right visa.
2. While we are generous with knowledge in your initial consult, it will not leave you with a full understanding of migration law. Migration law is not that simple! However, we will guide you and provide actionable steps to get you closer to visa approval.
We know a lot of other migration companies offer a 15-minute free discussion. But the truth is these sessions are not about helping you, they’re about giving you the hard sell. And you’ll be chatting to a salesperson not a qualified lawyer or migration agent.
At Freedom Migration our consultation sessions are designed to educate and empower. We take time to understand your story, and unique circumstances. We walk you through all the requirements and pitfalls. And we leave you with complete certainty about the next steps for your visa application process.
Honestly, we believe that the No Visa, No Fee offer made by other migration agents is a little misleading. Visa applications aren’t always a straight yes or no, often additional documentation is needed, a second application, or an appeal.
We’re upfront about our costs and charge a price that represents the work involved and our trusted reputation means we don’t have to rely on gimmicks to win new clients.
We operate in accordance with the Code of Conduct. Our Partner Visa Consultations are not a guarantee of Visa Application success. If we find there is no visa suitable for your situation, we will be honest and let you know. If your situation is complex and requires in more depth consideration in accordance with legislation then we will provide you with a fixed price quote for this.
